Mr. Gardner is the co-founder and Managing Principal at Capital Recovery Advisors (CRA). He is an experienced real estate and loan professional with over 30 years of experience in commercial transactions, including property development and sales, mortgage banking, and distressed debt workout. He has contracted and partnered with various governmental agencies and private lending institutions for the resolution and sale of debt and real estate, and has acted as a fiduciary for individual and institutional investors in negotiating the financing and sale of commercial property, as well as the settlement and sale of distressed loans and judgments.

Mr. Gardner has managed multiple governmental agency, and private institution contracts for debt recovery, asset disposition, commercial real estate underwriting, and lending institution oversight. The government agencies involved in these contracts include FADA, FHLB, RTC and FDIC. In 1993 Gardner’s firm was one of 25 firms selected by the RTC to be a JDC Partner in the resolution of distressed debt, and he acted as the Project Manager for this contract for 22 years. At CRA he continues to manage multiple contracts with private lenders and asset buyers for the workout and settlement of their acquired, and legacy, distressed loan and judgment portfolios.

Mr. Gardner holds a Master’s Degree in Business Administration from the University of Utah, is a licensed Real Estate Broker in the State of Texas, and has received extensive training in real estate, loan and credit analysis, property and borrower underwriting, and creditor and borrower rights. He has formed, owned, and managed over 15 companies focused on debt workout, debt purchase, debt sales, real estate, and mortgage banking.

Ms. LeRoy is responsible for the Sales and Business Development at Capital Recovery Advisors, and is currently involved in many industry organizations, such as RMA, IBAT, CCIM, TBA and FWIT. Tracy is a graduate of Texas A & M University. After graduation, her first job was as an inside sales representative with Landlock Seafood in Dallas, Texas.

Tracy quickly realized her passion for sales and being a representative of a company, which led to one of her proudest accomplishments early on, being awarded “Employee of the Year” for this thriving company. After two years with Landlock Seafood, Tracy moved to Detroit, Michigan to be with her fiancée, Keith.

While in Detroit, Tracy enjoyed an amazing career with a software manufacturing company called KOPY-RITE. Tracy quickly moved from an inside sales position, to managing an inside sales team, to becoming the sales and marketing manager.

She helped play a vital role in the company’s success and positive growth, year after year. After ten years in Michigan, Tracy had the opportunity to move back to Texas to be closer to family, and now resides in Katy, Texas, and is actively involved in the local community.

Mr. Tumminello joined Capital Recovery Advisors in 2009 and since that time has served simultaneously both as Corporate Counsel and as an Asset Manager, specializing in complex workouts. He has directly resolved or assisted in the resolution of hundreds of millions of dollars in distressed obligations, resulting in substantial recoveries for CRA and its clients. He has also overseen the design and implementation of the firm’s data management systems.

Prior to joining CRA, Stephen was an Associate at Marcus & Millichap, specializing in brokerage of retail investment properties. Immediately following law school Mr. Tumminello worked as an Associate Attorney at the firm of Porter & Hedges, L.L.P., where he specialized in business formations, securities law, and mergers and acquisitions. Before that time, Mr. Tumminello was employed for nine years at Quantitative Market Research, a small site selection firm where he specialized in retail site evaluation through qualitative and econometric analysis.

He received his B.S. in Economics summa cum laude from Texas A&M University and his J.D. with honors from the University of Texas School of Law. He is licensed to practice law in Texas and is a Texas Real Estate Broker.

Mrs. Upton joined Capital Recovery Advisors in 2013. She oversees assets from designation through the due diligence phase. Her due diligence team prepares each asset for collection by analyzing the loan from origination to present day, identifying the obligors, and pinpointing any points of leverage or legal issues that may arise.

Her due diligence team also removes assets that are uncollectable on receipt in order for our asset managers to more effectively and efficiently use their time to pursue viable assets.Prior to joining CRA, Mrs. Upton served as a Managing Attorney for a small firm in Houston, Texas where she ran the day-to-day operations and managed cases from the initial retainer all the way to trial.

Immediately following law school, Mrs. Upton worked as an Associate Attorney for the Law Office of Jacqueline Taylor, specializing in inventory and appraisements, separate property tracing, and complex divisions of marital estates. Mrs. Upton received her B.S in Corporate Communications magna cum laude from University of Texas at Austin and her J.D. from St. Mary’s School of Law. She has been licensed to practice law in Texas since 2008.
